FTC v. Superior Servicing LLC
Case Summary
On November 22, 2024, Krista Freitag was appointed as temporary receiver of SUPERIOR SERVICING LLC, and its subsidiaries, affiliates, successors and assigns pursuant to an Order entered by the United States District Court in the District of Nevada. The court order was requested by the Federal Trade Commission based on alleged violations of federal laws and regulations. On December 5, 2024, the Court continued the receivership indefinitely as to Superior Servicing LLC and on December 19, 2024, the Court continued the receivership indefinitely as to individual defendant, Merdjanian and in so doing, also specifically identified (and continued the receivership indefinitely as to) various additional entities affiliated or related to Superior Servicing.
At the December 19, 2024 hearing, the Court also determined that the evidence before it thus far indicates that violations of federal consumer laws have occurred. As a result, operations relating to the entities now in receivership, including those commonly known as Accredit, Student Processing Center (SPC), and SPCTWO, have been indefinitely suspended. Therefore, if you are a customer or member of any of these entities, we recommend that you promptly contact your lender or loan servicer directly to ensure any recertification or other requirements that may be necessary for you to remain eligible and/or enrolled in any student loan forgiveness, forbearance or other modification program are timely met. The entities in receivership are not able to provide any recertification or any other services relating to your student loan(s) at this time. Failure to do so could have adverse consequences if you are enrolled in a student loan forgiveness, forbearance or other loan modification program.
If you are in need of assistance, you should first speak directly to your lender or loan servicer as to what services they may provide. We also encourage and recommend that you seek the latest information about the status of student loan modification programs from Federal Student Aid, an office of the U.S. Department of Education, which can be found at the following website: Federal Student Aid. Please note that consumers can apply for the various student loan repayment and forgiveness or discharge programs through the U.S. Department of Education or their student loan servicers at no cost; these programs do not require the assistance of a third-party company or payment of fees.
